The Occupational Safety, Health and Working Conditions Code, 2020 defines "factory" as premises whereon twenty or more workers are working, or were working on any day of the preceding twelve months, where a manufacturing process is carried on with the aid of power, or whereon forty or more workers are so engaged where the process is carried on without the aid of power. This represents a substantial increase from the corresponding thresholds under the Factories Act, 1948, which set the limits at ten workers (with power) and twenty workers (without power). This threshold increase significantly reduces the number of smaller manufacturing premises brought within the Code's stringent factory-specific safety, health, and welfare compliance obligations, easing the regulatory burden on smaller manufacturing units.
