Under the Occupational Safety, Health and Working Conditions Code, 2020, wages for overtime work are payable-

Section 27 fixes the rate for overtime work at twice the rate of wages where a worker works beyond the prescribed hours of work in any day or in any week, and directs that the overtime period shall be calculated on a daily basis or a weekly basis, whichever is more favourable to the worker. Its first proviso adds the safeguard that the employer may require a worker to work overtime only subject to the worker's consent; the second proviso leaves the total number of overtime hours to be prescribed. There is no one-and-a-half-times rate, no exemption from the consent requirement, and no substitution of overtime wages by a compensatory holiday - the double rate on the favourable method of computation, coupled with consent, is the tested core.
