Under the Bharatiya Nagarik Suraksha Sanhita, 2023, in a case where the investigation relates to an offence punishable with death, imprisonment for life, or imprisonment for TEN YEARS OR MORE, the accused may be kept in custody during the investigation for a period not exceeding ___ days, (and up to ___ days in other cases), before the completion of the investigation or charge sheet:

The BNSS (mirroring the old CrPC position) provides, in the provision relating to custody during investigation (the remand provision, Section 187, read with the relevant limit), that the accused may be detained for a total period not exceeding NINETY DAYS where the investigation relates to an offence punishable with death, imprisonment for life or imprisonment for TEN YEARS or more, and SIXTY DAYS in any other case. If the investigation is not completed within that period and the accused has not been charge-sheeted, the accused is entitled to be released on bail (default bail). These 90/60-day ceilings are the custody-cum-default-bail anchor of the code.
