Ashok, a cashier in a bank, misappropriates ₹15 lakh of customer deposits entrusted to him in the course of his employment. Under the Bharatiya Nyaya Sanhita, 2023, Ashok, being a banker entrusted with property, is punishable under section 316(5) with:

Section 316 of the Bharatiya Nyaya Sanhita, 2023 deals with criminal breach of trust, that is, the dishonest misappropriation or conversion of property entrusted to a person, or its dishonest use or disposal in violation of any direction of law or any legal contract. Sub-section (5) provides an enhanced punishment where the offender is a banker, merchant, factor, broker, attorney or agent: imprisonment for life, or imprisonment for a term which may extend to ten years, and fine. Ashok, a cashier standing in the position of a banker with respect to the deposits, received the money in a position of trust and dishonestly converted it, squarely attracting the enhanced provision. The shorter sentences correspond to the general punishment for ordinary criminal breach of trust, and the possibility of civil recovery does not displace criminal liability.
