A confession which is NOT VOLUNTARY - or is induced by threat, promise or inducement, or made to a police officer - is, under the Bharatiya Sakshya Adhiniyam, 2023:

The BSA preserves the rule of evidence that a confession made under INDICEMENT, threat or promise, or which is otherwise not voluntary, is NOT relevant and cannot be proved against the person making it; confessions to a police officer are likewise not provable against the accused (the BSA carries forward the old Evidence Act's safeguards). Voluntariness at the time of making is the touchstone of admissibility, and even a subsequently-corroborated coerced confession remains inadmissible. This protective character distinguishes confession law from mere admissions. The voluntariness requirement is fundamental to a fair trial.
