A party wants to lead an ELECTRONIC RECORD as evidence but has not obtained, at the threshold, the prescribed certificate of the integrity of the computer/device. Under the Bharatiya Sakshya Adhiniyam, 2023 (Section 63), the court:

Admissibility of electronic records under Section 63 of the BSA (the successor to Section 65B of the old Evidence Act) ordinarily requires a certificate attesting to the integrity of the computer system from which the record was produced. The courts have clarified that this certificate is a condition of admissibility, but the provision read with the enabling judicial discretion allows the certificate to be dispensed with in the interest of justice, and the requirement is not insurmountable where the electronic evidence can otherwise be authenticated or found. Rigid, literal insistence on the certificate has given way to a functional approach sustaining electronic evidence. This balanced reading is the recent, exam-relevant position.
