R is arrested for an offence under the Bharatiya Nyaya Sanhita, 2023 punishable with imprisonment for a maximum term of six years. He is not released on bail and remains in detention during investigation, inquiry and trial for three years and six months. Under Section 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023:

Section 479(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 provides that a person detained during investigation, inquiry or trial who has not been released on bail shall be released on bail if the period of his detention exceeds one-half of the maximum period of imprisonment specified for the offence, subject to the provisos. One-half of six years is three years, and R has been detained for three years and six months, crossing the threshold. The provisos exclude offences punishable with death, imprisonment for life or imprisonment for a term of ten years or more, and cases where the person is also charged with another offence. Since the maximum here is six years, none of the exclusions applies and R must be released on bail.
