Under section 11 of the Indian Contract Act, 1872, a person is competent to contract only if he is of the age of majority, of sound mind and not disqualified from contracting, and the Privy Council in Mohori Bibee v Dharmodas Ghose (1903) laid down that an agreement with a minor is void ab initio, that is, dead from the start, and cannot be enforced against the minor. Such an agreement is neither voidable at the minor's option nor ratifiable after majority, because a void agreement cannot be confirmed. The only mitigation is section 68, under which a minor is liable, out of his own property, for necessaries supplied to him or to his dependents; a motorcycle bought on credit does not answer that description. The agreement is therefore void ab initio.
