A cashier of a scheduled bank dishonestly misappropriates ₹40 lakh of deposits entrusted to him in the course of his employment. Under s.316 of the Bharatiya Nyaya Sanhita 2023, he is liable to:

Criminal breach of trust is defined in s.316 of the Bharatiya Nyaya Sanhita 2023: whoever, being entrusted with property, or with dominion over property, dishonestly misappropriates or converts it to his own use, or dishonestly uses or disposes of it in violation of any direction of law or legal contract, commits criminal breach of trust. The general punishment extends to imprisonment for five years, or fine, or both. Clause (5) of s.316 provides a higher punishment where the offence is committed by a public servant, banker, merchant, factor, broker, attorney or agent: imprisonment for life, or imprisonment which may extend to ten years, and fine. A bank cashier misappropriating deposits entrusted to him in the course of his employment falls within this banker's clause, attracting the enhanced punishment.
