Section 63 of the Bharatiya Nyaya Sanhita, 2023 defines rape: a man commits rape if he has sexual intercourse with a woman against her will, without her consent, with her consent obtained by putting her in fear of death or hurt, with her consent while she believes him to be her husband, with her consent when she is incapable of understanding the nature and consequences of the act, or with or without her consent when she is under eighteen years of age. Section 64 separately provides the punishment, namely rigorous imprisonment of not less than ten years, which may extend to imprisonment for life. Section 65 covers rape of a woman under sixteen years, section 70 gang rape, and section 74 outraging the modesty of a woman. The definition therefore resides in section 63.
