Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, anticipatory bail may be granted by the High Court or the Court of Session, but no such application for anticipatory bail is maintainable in relation to offences punishable under -

Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 empowers the High Court or the Court of Session to grant anticipatory bail to a person apprehending arrest on an accusation of having committed a non-bailable offence, on such conditions as the court thinks fit. The provision expressly disapplies anticipatory bail where the accusation relates to offences punishable under Sections 65 and 70(2) of the Bharatiya Nyaya Sanhita, 2023, which cover aggravated sexual offences attracting long terms of imprisonment. Murder under Section 103, snatching under Section 304, theft under Section 303 and kidnapping under Section 137 of the BNS do not carry the statutory bar under Section 482 of the Sanhita. Hence Sections 65 and 70(2) identify the excluded offences, making the second option correct.
