Section 19 of the Mediation Act, 2023 requires the MEDIATION SETTLEMENT AGREEMENT to be in writing and duly signed by the parties AND the mediator (and by their authorised representatives), and Section 27 makes such an agreement BINDING and ENFORCEABLE in the same manner as a judgment or decree of a court. The signature of both the parties and the mediator authenticates the settlement and triggers its enforceability. A mere oral agreement is not a settlement agreement under the Act, and notarial certification is not a precondition to validity. The signed-then-enforceable pattern is the Act's core design.
