The provisions of the Right to Information Act, 2005 are designed to have an OVERRIDING effect over inconsistent provisions in other enactments (including, to the extent it is applicable, the Official Secrets Act). This overriding effect is provided by:

Section 22 of the RTI Act, 2005 gives the Act an OVERRIDING effect: 'The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act, 1923, and any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act.' This supremacy ensures the transparency framework prevails over confidentiality statutes, subject to the exemptions of Section 8 and the specified exclusions under Section 24. The override is fundamental to the Act's object of maximum disclosure. The RTI Act thereby supersedes conflicting secrecy regimes.
