Under Section 24 (Burden of Proof): 1. In a trial under this Act, the burden of proving that proceeds of crime are untainted lies on the accused. 2. Prosecution has to first establish that the property is proceeds of crime. 3. The provision applies only after a charge is framed. 4. Section 24(2) places burden on person in possession of proceeds of crime.
