As per Section 3 of the Patents Act, 1970, the following are not inventions and thus not patentable: • Section 3(d): Mere discovery of a new form of a known substance • Section 3(i): Any process for the medicinal, surgical, curative, prophylactic, diagnostic, therapeutic or other treatment of humans or animals • Section 3(m): Mere schemes or methods of performing mental act or method of doing business In particular, traditional knowledge, such as yoga, is explicitly excluded from patentability under Indian law, to prevent misappropriation of indigenous practices.
