The owner of a RARE, practically unique item (a one-off antique) refuses to deliver it to a party with a valid contract to buy it, and the unique article is not available in the market. The buyer sues. Under the Specific Relief Act, 1963:

Specific performance is granted where DAMAGES do not afford adequate relief. For a UNIQUE article (rare, one-off, or of special value not obtainable in the market), money cannot compensate the buyer for being deprived of the very thing, so the court may decree specific delivery/performance under the specific-relief remedy (and, for specific movable property of which the buyer is entitled to possession, recovery under Section 7/8). The adequacy-of-damages test is applied to the particular articles. Ordinary, replaceable market goods, by contrast, would be remedied by damages. The uniqueness of the subject-matter is decisive.
