Under the Industrial Relations Code, 2020, a "Negotiating Union" or "Negotiating Council" is constituted in an industrial establishment to negotiate with the employer. Section 14 of the Industrial Relations Code, 2020 governs the recognition of a negotiating union or council. Where there is only one registered trade union of workers in an establishment, the employer must recognise such union as the sole negotiating union if it has at least 51 per cent of the workers on its membership roll. Where more than one registered trade union exists, the union having the support of at least 51 per cent of workers is recognised as the sole negotiating union. If no single union meets the 51 per cent threshold, a negotiating council is constituted comprising representatives of unions having at least 20 per cent of the workers, with one representative for every 20 per cent. This provision is intended to give a clear and legitimate bargaining agent to deal with the employer.
