Criminal breach of trust is defined in Section 316 of the Bharatiya Nyaya Sanhita 2023, which punishes a person who, being in any manner entrusted with property or with dominion over property, dishonestly misappropriates or converts it to his own use. The essential ingredient of entrustment distinguishes it from theft under Section 303 and from criminal misappropriation under Section 314, neither of which requires entrustment. The cashier was entrusted with the customers' deposits by reason of his employment at the teller counter and dishonestly misappropriated twenty-five lakh rupees through false entries, attracting Section 316. Clause (5) provides that where the offender is a banker, merchant, factor, broker, attorney or agent, the punishment is imprisonment for life, or imprisonment up to ten years, and also fine.
