Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 deals with the admissibility of electronic records. It provides that electronic records are admissible in evidence and that their contents may be proved in accordance with the provisions governing electronic records, including by producing the record or a printed or electronic copy before the court, accompanied by a certificate where required. Section 64 correspondingly requires oral evidence to be direct, while Section 60 regulates secondary evidence, of which a copy of an electronic record may be one species. Section 26(a) concerns dying declarations, Section 41 deals with expert opinion on handwriting and fingerprints, Section 121 embodies estoppel and Section 157 concerns hostile witnesses. Hence Section 63 is the provision governing electronic records.
