Mortgage by deposit of title-deeds .—The provisions hereinbefore contained which apply to a simple mortgage shall, so far as may be, apply to a mortgage by deposit of title-deeds. The provisions of simple mortgage shall apply to a mortgage by deposit of title deeds (also known as equitable mortgage), as per Section 58(f) and Section 96 of the Transfer of Property Act, 1882. This means that, unless otherwise agreed, the rights, remedies, and procedures that apply to simple mortgages also apply to a mortgage by deposit of title deeds.
