Section 26 of the Occupational Safety, Health and Working Conditions Code, 2020 deals with weekly and compensatory holidays. It provides that no worker shall be required or allowed to work in an establishment for more than six days in any week, and every worker is entitled to a weekly holiday. Where a worker is deprived of a weekly holiday, for example due to the exigencies of continuous process work, he is entitled to compensatory holidays of equal number within the prescribed period. This ensures adequate rest and prevents overwork. The provision continues the protective framework earlier found in the Factories Act, 1948 and shop and establishment laws.
