Section 40 of the Industrial Relations Code, 2020 requires that no employer shall effect any change in the conditions of service applicable to any worker in respect of matters specified in the Third Schedule without giving notice of the nature of the change in the prescribed manner. Such notice must be given within twenty-one days of effecting such change, and the change cannot be brought into force during the pendency of related proceedings before a Tribunal. The Third Schedule covers matters such as wages, contribution to provident fund, allowances, hours of work, leave and rest intervals.
