Question
Under the PMLA, the Adjudicating Authority is appointed by whom?
Solution
Under Section 6 of the Prevention of Money Laundering Act, the Central Government appoints an Adjudicating Authority to exercise jurisdiction, powers and authority conferred by the Act, in particular to decide whether attached property constitutes proceeds of crime. The Adjudicating Authority confirms or sets aside provisional attachment orders after giving the affected persons an opportunity of hearing. It functions as a quasi-judicial body. Its role is distinct from that of the investigating agency and the Special Court.
