The Mediation Act, 2023 makes a mediation SETTLEMENT AGREEMENT (signed by the parties and the mediator) BINDING and ENFORCEABLE in the SAME MANNER as a judgment or DECREE of a court (Section 27). Where a party breaches it, the aggrieved party may seek its enforcement through the appropriate execution/legal processes treating the settlement agreement like a decree - an enforceable, terminal resolution rather than a mere pact. The Act also itself makes such agreements partly determinative in a pending suit. This enforceability gives voluntary mediation the teeth of a court judgment. The breached-settlement consequence is therefore execution-backed.
