The Mediation Act, 2023 prescribes that a mediation should ordinarily be concluded within a specified time - a period of SIXTY DAYS extendable by a further THIRTY DAYS with the consent of the parties (per the Act; institutional rules may differ). Where no settlement agreement is reached within that time, the mediation is deemed to have FAILED (no agreement), the parties' rights remain unaffected, and the court or the litigation continues from where it was - the mediator may issue a failed-mediation certificate. The default preserves the parties' access to adjudication. Time-bound mediation with deemed failure is a core procedural feature of the Act.
