After passing an EVICTION ORDER, if the unauthorised occupant refuses or fails to vacate, the Estate Officer under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 may:

Section 5(3) of the Public Premises (Eviction) Act, 1971 empowers the Estate Officer, where a person refuses to comply with the eviction order, to EVICT the person from and take possession of the premises, and for that purpose he may use such FORCE as may be necessary and may also avail himself of the assistance of any police officer. The statutory power of forcible (but police-assisted) recovery underscores the summary, self-executing nature of the Act's eviction machinery - the Estate Officer does not need to file a civil suit. The occupant's remedy lies in the appeal to the District Judge.
