Section 2(h) of the Competition Act, 2002 defines 'enterprise' broadly to mean a PERSON or an ASSOCIATION (and its units/divisions/subsidiaries, and departments exercising commercial), engaged in any activity relating to the production, storage, supply, distribution, acquisition or control of articles or goods, or the provision of services of any kind. The breadth ensures the Act covers a wide swathe of economic actors, though it does not apply to sovereign functions of the State or to acts of the Government done in its sovereign capacity. This wide definition delineates the Act's personal scope. 'Enterprise' and 'person' thus ground the anti-competitive-agreement and dominance provisions.
