The Mediation Act, 2023 expressly recognises ONLINE MEDIATION and provides for it to be conducted using online mechanisms, with the Mediation Council of India and the rules prescribing modalities for remote mediation under the Act. This brings digital dispute resolution within the statutory framework, enabling cost-effective and location-agnostic mediation. Community mediation and institutional mediation are also recognised modes. The recognition of online mediation reflects the Act's modern, access-oriented design. Parties across jurisdictions cannot, under the Act, be forced to appear only in person.
