Section 2(zr) of the Industrial Relations Code, 2020 defines "worker" to include any person employed in an industry to do manual, unskilled, skilled, technical, operational, clerical or supervisory work, but expressly excludes persons employed mainly in a managerial or administrative capacity (excluded irrespective of wage level), and persons employed in a supervisory capacity drawing wages exceeding eighteen thousand rupees per month, or such higher amount as may be notified by the Central Government from time to time. This is a substantial increase from the ten thousand rupees threshold that applied under the corresponding provision of the Industrial Disputes Act, 1947. The distinction matters because only "workers" enjoy the specific protections relating to lay-off, retrenchment, standing orders, and strike/lock-out provisions under the Code; supervisory staff above this wage ceiling and all managerial/administrative staff fall outside this protective framework.
