A citizen's fundamental right is violated, not by the State, but by a PRIVATE individual or body not performing any public function. The citizen approaches the High Court for a writ. As a general rule under Articles 226/32, a WRIT:

The writ jurisdiction under Articles 32 and 226 proceeds against the STATE and public authorities, and is not, in the ordinary course, directed against purely private individuals or bodies not discharging any public function. A private actor's action is generally remediable through civil/criminal remedies, not by a constitutional writ. However, where a private body performs a PUBLIC function or is regulated to that degree, writs may exceptionally issue (e.g., against bodies exercising public-law functions or amenable to judicial review on that account). The essential 'public function/public authority' character is the touchstone. Private contractual wrongs are thus outside the ordinary writ domain.
