Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 reproduces the substance of the former Section 34 of the Indian Penal Code: when a criminal act is done by several persons in furtherance of the common intention of all, each of such persons is liable for that act in the same manner as if it were done by him alone. Common intention must be shared, though it may develop at the spur of the moment. Section 45 defines abetment, Section 61 deals with criminal conspiracy, and Section 62 prescribes a general punishment for attempts, while Section 103 punishes murder. Because the doctrine of joint liability formerly embodied in Section 34 IPC now stands in Section 3(5) of the Sanhita, the first option is correct.
