The opinions of EXPERTS - persons especially skilled in foreign law, science, art, handwriting or finger impressions - are made relevant under which section of the Bharatiya Sakshya Adhiniyam, 2023?

Section 39(1) of the Bharatiya Sakshya Adhiniyam (the successor to Section 45 of the old Evidence Act) makes the opinion of experts relevant, where the court has to form an opinion upon a point of foreign law, or of science or art, or as to identity of handwriting or finger impressions. The expert's opinion is, however, only counsel to the court and is not conclusive; the court applies its own judgment. Section 33 concerns facts showing motive and Section 47 public documents. Expert-opinion evidence is foundational in cases turning on technical questions.
