Section 3(5) of the Bharatiya Nyaya Sanhita 2023 carries forward the rule of joint liability formerly found in Section 34 of the Indian Penal Code: when several persons do an act with a common intention, each of them is liable for that act in the same manner as if it were done by that person alone. Common intention requires a shared intention formed before or at the time of the act and is distinct from abetment. Section 45 defines abetment, Section 61 deals with criminal conspiracy, and Section 62 provides that a person attempting an offence is liable to half the punishment of the completed offence. Section 2(10) defines wrongful gain. Because the rule requires a shared intention rather than instigation or an agreement, the correct provision is Section 3(5).
