Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 enables a secured creditor, after giving the prescribed notice, to file an application before the Chief Metropolitan Magistrate or the District Magistrate within whose jurisdiction the secured asset or other documents relating to it are situated, seeking assistance in taking possession of the secured assets and documents. The Magistrate may then take possession and forward them to the creditor, and section 14(3) as amended requires suitable orders to be passed within thirty days of the application.
