Section 32 of the Occupational Safety, Health and Working Conditions Code, 2020 governs annual leave with wages. A worker who has worked for a period of 240 days or more in a calendar year is entitled to leave with wages in the subsequent calendar year. The rate of such leave for an adult worker is one day for every twenty days of work performed during the previous calendar year, while for a young worker (below 18 years) it is one day for every fifteen days of work. The provision also allows accumulation of leave up to a prescribed limit and entitles the worker to encashment of unavailed leave. This consolidates and standardises the earlier leave provisions of the Factories Act, 1948.
