Under the Explanation to Section 452, work in an establishment shall not be deemed to be of an intermittent nature if it was performed for more than one hundred twenty days in the preceding twelve months, or if it is of a seasonal character and performed for more than sixty days in a year. If a dispute arises whether work is intermittent or casual, the appropriate Government decides after consultation with the National Board or a State Advisory Board, and its decision is final.
