Under Section 144, if the employer is not satisfied about the existence of imminent danger apprehended by the employees, he must nevertheless refer the matter forthwith to the Inspector-cum-Facilitator, whose decision on the question of the existence of such imminent danger shall be final. This protects the workers right under Section 141 to represent safety concerns and, if not satisfied, to escalate to the Inspector-cum-Facilitator. A parallel provision exists in Section 89 for hazardous processes in factories.
