Under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, no court has jurisdiction in respect of eviction of unauthorised occupants of PUBLIC PREMISES or matters relating to them, as the special jurisdiction is conferred on the Estate Officer and the appeal forum. Section 15 of the Public Premises (Eviction) Act, 1971 bars the jurisdiction of the CIVIL COURT: no court shall have jurisdiction to entertain any suit or proceeding in respect of eviction of unauthorised occupants from public premises or matters connected therewith, and no injunction shall be granted by any court against the Estate Officer in respect of such eviction. Section 5 confers the eviction power on the Estate Officer, Section 9 the appeal to the District Judge, and Section 2 the definitions. The ouster makes the Act's special machinery the exclusive route. This exclusivity underpins the summary eviction regime.
