Section 8(2) of the RTI Act provides that notwithstanding the exemptions, information which cannot be denied to Parliament or a State Legislature shall not be denied to any person. More relevantly, in the context of personal information, the courts read the exemptions (especially Section 8(1)(j) and the fiduciary/commercial-confidence clauses) subject to a PUBLIC-INTEREST OVERRIDE: disclosure is permitted where the larger public interest in access outweighs the harm to the protected private interest. The Act thus builds in a balance between confidentiality and accountability. A blanket refusal is not permissible; the authority must apply the public-interest test. This balancing is central to RTI jurisprudence.
