The Consumer Protection Act, 2019 defines an 'e-commerce entity' (Section 2(16)) as a person who owns, operates or manages a digital or electronic facility or platform for electronic commerce. E-commerce entities are squarely within the Act's jurisdiction: they must not display misleading advertisements or engage in unfair trade practices, and they are answerable to consumer claims concerning transactions on their platforms, in addition to the intermediary duties. The 2020 Consumer Protection (e-commerce) Rules further regulate the duties. E-commerce is therefore a regulated segment, not a regulatory no-man's-land.
