A consumer buys a life-saving medicine manufactured by a company which turns out to be SUB-STANDARD and causes him physical harm after he ingests it as directed. He files a claim against the manufacturer. Under the Consumer Protection Act, 2019:

The Consumer Protection Act, 2019 enacts a statutory PRODUCT LIABILITY regime (Sections 2(34) and 82-87) under which a product MANUFACTURER, product seller or product service provider is liable to compensate for HARM caused by a product, and the consumer need not prove negligence in the conventional tort sense; it suffices to establish the harm and that the defect existed, subject to the statutory defences. This eases the burden on the injured consumer. A sub-standard medicine that harms the consumer squarely engages the manufacturer's product liability. The remedy lies before the consumer fora. Product liability is one of the Act's most important innovations.
