The Consumer Protection Act, 2019 introduced express PRODUCT LIABILITY provisions (Sections 2(34) and 82-87): a product manufacturer, product seller or product service provider is liable to compensate for harm caused by the product, and the claimant need not prove negligence in the ordinary tort sense once the statutory conditions (a defect in the product or inadequate instruction, causing harm) are established. The claimant must still establish the harm and the defect on a balance of probabilities. The defence of fault and risk is statutorily limited.
