Explanation: The Mediation Act, 2023 protects the CONFIDENTIALITY of the mediation process: a party's statements, admissions, offers or documents shared in mediation are not admissible as evidence in any subsequent civil or criminal proceedings. This candour-facilitating protection lets parties negotiate openly without fear that their concessions will later be used against them in litigation. The mediator's communications are likewise confidential. Section 23 of the Act addresses the confidentiality and non-admissibility of mediation communications. Only the resulting signed settlement agreement is enforceable; the mediation dialogue itself stays off the record.
