Mohori Bibee v. Dharmodas Ghose declared a minor's agreement void ab initio, holding that the contract law's requirement of competence (Section 11) makes a minor incapable of contracting. The Privy Council refused restitution of money paid under the void agreement, so the principle also bars unjust enrichment against the minor's estate in most cases. A minor can, however, be made a beneficiary, and necessaries supplied to him may be recovered under Section 68. This landmark is the anchor for all capacity-of-parties questions.
