Section 2(35) of the Code on Social Security, 2020 defines an inter-state migrant worker as a person who is recruited directly by the employer or through a contractor in one state for employment in an establishment in another state, and who earns up to ₹18,000 per month or such higher amount as may be notified. A significant reform under the Code is that it allows workers to self-register themselves as inter-state migrant workers on a national portal, without requiring the previous mandatory contractor registration. Such workers are entitled to a displacement allowance equal to 50% of monthly wages and a journey allowance for travel to and from their home state. The Code also extends portability of social security benefits to migrant workers, meaning their PF and ESI entitlements follow them across state borders.
