Section 39 of the BSA, 2023 (corresponding to the former Section 45 of the Indian Evidence Act) provides that when the court has to form an opinion upon a point of foreign law, or of science, or art, or as to identity of handwriting or finger impressions, the opinions upon that point of persons specially skilled in such foreign law, science, or art, or in questions as to identity of handwriting or finger impressions, are relevant facts. Such persons are called experts. However, expert opinion is advisory, not binding-the court is not obliged to accept it. The Supreme Court in Ramesh Chandra Agrawal v. Regency Hospital (2009) held that expert evidence is opinion evidence and has to be assessed like any other evidence. Courts must evaluate the credibility, qualifications, and reasoning of the expert before relying on the opinion.
