Dissatisfied with the measures taken by a secured creditor under Section 13(4) of the SARFAESI Act, 2002, a borrower may file an appeal before the Debts Recovery Tribunal within -

Section 17 of the SARFAESI Act, 2002 provides that any person aggrieved by any of the measures referred to in Section 13(4) may prefer an appeal before the Debts Recovery Tribunal having jurisdiction, within forty-five days of the date on which such measures were taken. The Tribunal, after satisfying itself about the legality of the measures, may restore possession of the secured asset to the borrower or set the measures aside. A further appeal against the order of the Tribunal lies to the Appellate Tribunal under Section 18, subject to the deposit of an amount not less than twenty-five per cent of the debt claimed. The fifteen-day, thirty-day, sixty-day and ninety-day figures do not match the statutory period, so filing within forty-five days is correct.
