Section 62(1)(a) of the Industrial Relations Code, 2020 prohibits any person employed in an industrial establishment from striking without giving the employer notice within sixty days before striking. Clause (b) additionally bars striking within fourteen days of giving such notice, and clause (c) bars striking before expiry of the strike date mentioned in the notice. This significantly extends the earlier notice period of six weeks prescribed under Section 22 of the Industrial Disputes Act, 1947, giving greater scope for conciliation. The Code also restrains strikes during pendency of conciliation, Tribunal, or arbitration proceedings and for defined cooling-off periods thereafter, failing which the strike is rendered illegal.
