      Section 43(1) of PMLA provides that the Central Government, in consultation with the Chief Justice of the High Court, shall by notification designate one or more Courts of Session as Special Court or Special Courts for the trial of offences punishable under Section 4. The 'High Court' in this context means the High Court of the State in which the Sessions Court so designated was functioning immediately before designation. Under Section 44, both the scheduled offence and the Section 4 offence are triable only by the Special Court. Section 46 makes the Special Court deemed to be a Court of Session for the purposes of the Code of Criminal Procedure, 1973. Cognizance can be taken only on a complaint by the Director or an authorised officer.
